The London Strawberry Festival, hereby leases certain space on the festival grounds to be used during the 2005 London Strawberry Festival. The location of each space will be assigned by the London Strawberry Festival, and the business of running each space will be conducted to the satisfaction of the London Strawberry Festival Board of Directors according to the rules listed below. The London Strawberry Festival assumes no responsibility and shall not be held liable for loss or damage to lessee's property, loss of business, or personal injury. Further, London Strawberry Festival makes no warrants or claims to amount of business lessee may have during the London Strawberry Festival. London Strawberry Festival reserves the right to refuse contract with any individual, organization, or business, whether for profit or nonprofit. Therefore, upon acceptance of this contract, the lessee agrees to the following terms and conditions:

1.

Lessee may not sublease their space, nor assign or sell this contract to another party.

2.

Lessee is only leasing a bare space. Lessee must provide own equipment, shelter, tables, chairs, lights, employees, volunteers, etc.

3.

Festival has exclusive rights to ban or forbid the display or sale of items it feels is questionable or inappropriate.

4.

Lessee shall refrain from any behavior which is deemed disruptive or annoying to the harmony of the festival and other attendees.

5.

Vehicles that are not connected with rides, concessions, or on display shall be removed from the area during the festival hours of operation.

6.

A minimum of twenty (20) feet shall be maintained in all streets, midways, and alleys for fire lanes. Any vehicle blocking a fire lane at any time will be towed at the owner's expense.

7.

The festival Board of Directors shall mediate all disputes and their ruling in such matters will be final.

8.

The following items are banned for sale: Any class of fireworks; poppers; silly string; stink spray; potato guns; any item which fires or projects any object; blow guns; sling shots; guns of any type, play or real; any item which causes or is caused to annoy, assault, insult, injure, bring harm to, invade, embarrass, interrupt, disturb or upset the peaceful enjoyment of the festival by anyone on the festival grounds.

9.

No alcohol or illegal drugs permitted.

10.

All of lessee's property must be physically contained on the street and no closer than six (6) inches from the edge of the curb or rain gutter.

11.

Nothing is to be set or erected on the sidewalks without approval from the festival president, vice president, or vendor chairman.

12.

Nothing is to be placed into the ground, street, etc., such as but not limited to: stakes, nails, screws, etc. No one has authority to override  this rule. You may be charged for street repair by the city of London if caught doing so.

13.

You are responsible for all trash in your assigned space and in front of your space to the middle of the street. It must be cleaned each evening after festival close, 11 P.M. Place bagged and boxed trash in front of your assigned space for the clean up crew.

14.

Lessee agrees to comply with all state, local, and NEC electrical codes.  Use must use NEC rated 12 or 14 gauge “outdoor” extension cords!!

15.

Lessee shall provide on contract the voltage and amperage needs of their operation.

16.

Electrical connections will only be performed by designated festival electricians.  Use must use NEC rated 12 or 14 gauge “outdoor” extension cords!!

17.

Upon arrival, priority on electrical hook up will be given to food concessions with perishable foods.

18.

Electrical connection will be performed as soon as possible on a first come, first served basis, and according to rule 17.  Use must use NEC rated 12 or 14 gauge “outdoor” extension cords!!

19.

Water is provided only on Main St.

20.

No waste (gray) water is to be dumped or drained into the gutters, curbs, or sewers. Waste (gray) water dumping tanks will be provided. Illegal dumping could result in EPA or city legal action against you.

21.

All concessions must provide a copy of their concession liability insurance coverage amounts page at sign in. The minimum liability coverage must be one million dollars ($1,000,000.00).

22.

All concessions are subject to Board of Health regulations.

23.

All concessions are subject to state and local Fire Code regulations.  Fire Extinguishers are required for ALL VENDORS.

24.

All concessions must sell a minimum of one type of strawberry food item.

25.

The London Strawberry Festival holds all exclusive rights to sell any strawberry shortcake type items for 2005

26.

The London Strawberry Festival holds all exclusive rights to Cotton Candy, Candy Apples, Mexican Food Items, and standard popped  buttered popcorn to be sold by Michaels Amusements..

27.

There are no exclusives on beverages except lemonade.

28.

All concessions must list every item they intend to sell. All food, all drinks, and their strawberry food item(s). This list must be approved by the festival board.  We will limit into the festival the top (2) listed items on your contract

29.

All 2005 food vendors will be allowed to sell items listed on their 2004 contract without restriction with exception to rule 25 and 26

30.

No items may be added to the approved menu.

31.

No items may be deleted from the approved menu.

32.

No individual condiment packets are permitted. (Catsup, mustard, mayonnaise, etc.)

33.

Failure to adhere to these rules could result in your expulsion from the festival without refund. 

34.

No refunds after May 15, 2005.   Refunds prior to May 15, 2005 will be subject to a $10 handling fee. 

The London Strawberry Festival is a rain or shine event.

35.

 

Senior vendors have until January 1, 2005 to secure same space as last year.

After January 2, 2005, new vendors will be booked on a first come, first serve basis according to the date of contract submission and types of products.

36.

Set up time is June 22, 2005 from 8 A.M. – 4 P.M.

37.

 

Tear down time is June 25, 2005 from 11 P.M.- June 26, 2005 at 6 A.M. You must be gone by 6 A.M. The city of London may remove your equipment if you are not gone by June 26, 2005 at 6 A.M. You will be responsible for any expenses incurred if this happens.

38.

You are responsible to confirm your acceptance into the festival.  There is a conformation page to verify your acceptance.  At the home page, click open the site on the link “Confirmations”.   If your name is not on the page within fifteen (15) days of your submission, contact the festival through the “Contact” link on the home page

39.

The London Strawberry Festival reserves the right to amend these rules at any time without notice by the official start of the festival!
